Important: Please read these Terms before registering or purchasing access. They govern your use when properly presented and accepted, subject to mandatory rights under applicable law.
1. Contracting party, eligibility and acceptance
Your contracting party is LaiNetiv Careers, operating under the brand name LaiNetiv, a registered sole proprietorship in Kenya. The business name is not a separate limited-liability entity. Business address: South C, Rangers Court, Kenya.
“We,” “us,” and “our” refer to LaiNetiv Careers, operating under the brand name LaiNetiv.
“You” means a platform user, including a seeker, employer or affiliate, as relevant. An employer representative must have authority to act for the organisation. An opportunity is a career-related listing. Users must have legal capacity to enter the relevant agreement. Under-18 use requires appropriate parental or guardian consent and oversight; a parent or guardian must participate where needed for a binding agreement. The under-18 signup flow requests a guardian’s email and keeps access pending until their approval. Guardian approval does not by itself purchase access or authorise recurring charges.
These Terms apply when properly presented and accepted. Acknowledging the Privacy Policy does not give blanket consent to optional marketing or unrelated data processing.
2. What LaiNetiv provides
LaiNetiv is an opportunity-discovery and matching service. Our purpose is to make discovering relevant opportunities easier, more organised and more efficient.
We may search for, collect, organise, review, verify, match and distribute opportunities. Companies may also submit opportunities directly to the platform. Because information can originate from third parties, we do not sell or represent our service as an absolute guarantee that every opportunity is genuine, suitable, current, available, complete, lawful or successful.
3. No guarantee of outcomes
We do not guarantee employment, an internship placement, an interview, an offer, compensation, acceptance, application success or any particular career outcome.
A company may close an application early, change requirements, withdraw an opportunity, alter compensation or modify its recruitment process after publication.
4. Verification is not an absolute warranty
Where we describe an opportunity as searched, reviewed or verified, that means we performed checks using information and methods we considered reasonably appropriate at the relevant time. It does not constitute certification, legal guarantee, endorsement or continuing warranty.
Users remain responsible for exercising reasonable judgment before applying, communicating with a recruiter, sharing information, attending an interview, accepting an offer or committing money or other resources.
5. Company responsibilities
Companies are responsible for the opportunities and information they submit. A company represents that it has the right and authority to submit its content and that its listings are accurate, lawful, non-fraudulent, non-malicious and not materially misleading.
Companies must not use LaiNetiv to publish fake or deceptive opportunities, impersonate another organisation or person, conduct phishing, distribute malware, request unlawful payments, harvest personal data for unrelated purposes, advertise unlawful activity, or otherwise abuse the platform.
6. Fraud, fake opportunities and malicious conduct
Where a company or other party intentionally submits fraudulent, fake, malicious, deceptive or unlawful opportunities, attempts to defraud users, compromises platform security or materially abuses LaiNetiv, we may remove content, suspend or terminate access, preserve relevant records and take further action.
Where appropriate, we may report suspected fraud, cybercrime or other unlawful conduct to competent authorities and pursue civil or other remedies available under Kenyan law. This includes seeking damages, costs, injunctive relief or other lawful remedies where appropriate.
7. User responsibilities
- Provide information that is accurate and not misleading.
- Keep account credentials secure.
- Use LaiNetiv only for lawful purposes.
- Do not scrape, overload, interfere with or attempt to compromise the platform, or reverse engineer it except where applicable law permits.
- Do not impersonate another person or organisation.
- Do not use the platform to harass, defraud or unlawfully target others.
- Independently verify material facts before making important decisions based on an opportunity.
8. Applications and employer relationships
Following an application link generally takes you to an employer or third-party service. The recruitment or employment contract is with that provider; we do not make hiring decisions or promise a placement merely by displaying a listing.
Employers are responsible for their hiring decisions, workplace and employment obligations. This does not excuse us from responsibility for its own representations, conduct or mandatory legal obligations. Any mandatory obligations that apply to our activities remain unaffected.
9. Accounts and security
Keep credentials secure, provide accurate information and promptly report suspected unauthorised access. Do not share or sell account access. Responsibility for unauthorised activity depends on the circumstances and applicable law; you are not automatically liable for every action involving a compromised account.
10. Paid access and renewal
Paid access currently costs KSh 200 for a monthly recurring subscription or KSh 200 for one-time access lasting 30 days from successful payment. The recurring option renews through Paystack until cancelled; the one-time option does not automatically renew. Confirm the payment type, charge, currency, interval and features shown before accepting checkout.
Displayed conversions into another currency are estimates; the checkout charge and any payment-provider conversion or fees must be checked before payment. Access purchases the stated platform features, not interviews, employment or a particular volume of suitable listings.
A future price or renewal change requires appropriate advance notice and any acceptance required by law. It does not authorise an undisclosed or retrospective charge. Payment-provider terms apply to their services without removing our own obligations.
11. Cancellation, refunds and consumer remedies
Use the subscription cancellation control to stop a recurring subscription. The system confirms cancellation only after the payment provider confirms disabling renewal. If the control fails or a charge is disputed, contact support@lainetiv.com promptly with the transaction reference; do not send card credentials.
One-time access expires after 30 days. Ordinary cancellation does not automatically refund correctly supplied access already used. Mandatory rights to cancel, refunds for legally qualifying circumstances, unauthorised charges and remedies for deficient or misrepresented services remain available, including applicable rights for internet agreements under Kenyan consumer law. We do not impose a blanket “no refunds” rule.
Account closure is separate from stopping renewal. Request both if desired. If we discontinue a paid service or terminate access without your material breach, any refund or other remedy required by law remains available.
12. Intellectual property
We and our licensors retain rights in the platform, software, branding, design, text, graphics and other original materials except third-party materials. You may use the service for its intended purpose but may not reproduce, resell, commercially exploit, scrape or redistribute protected materials without permission, except where permitted by law.
13. Submitted content and third-party rights
You retain ownership of materials you submit. You grant a non-exclusive, worldwide, royalty-free licence to host, format, display and distribute those materials only as reasonably needed to provide and communicate the service. The licence does not permit unrelated resale of personal data and remains subject to privacy law.
You must have authority and necessary rights to submit listings, logos and contact details. Removal ends ordinary future display, subject to reasonable technical removal time, lawful recordkeeping and copies already distributed. Public availability of another party’s listing does not itself grant redistribution permission. Rights holders can report disputed content at support@lainetiv.com.
14. Third-party services
We may link to company websites, application portals, payment services and other third-party resources. We do not control those services and do not guarantee their availability, security, accuracy, legality or suitability.
15. Availability and service changes
We aim to provide a useful and reliable service but do not guarantee uninterrupted or error-free operation. Maintenance, outages, third-party failures, security incidents and circumstances beyond our reasonable control may affect availability.
We may change, suspend or discontinue features where reasonably necessary for operational, legal, security or commercial reasons. Material changes to a paid service require appropriate notice and any remedy required by applicable law.
16. Service qualifications
Subject to mandatory law, the service is provided as available and opportunity information may contain errors or become outdated. Verification describes checks performed at a particular time, not certification or a continuing warranty. Read the description of any badge or check and independently confirm important details before acting.
These qualifications do not override express promises made at purchase, required standards of service, truthful advertising, consumer remedies or data-protection duties. Report suspected fraudulent listings promptly.
17. Liability and non-excludable rights
To the extent permitted by applicable law, We and our proprietor are not liable for indirect or consequential losses that were not reasonably foreseeable when the relevant agreement was made, or losses caused solely by independent third parties for whom we are not legally responsible. You should take reasonable steps to reduce avoidable loss.
Nothing excludes liability for fraud or fraudulent misrepresentation by us, wilful misconduct, death or personal injury where exclusion is prohibited, or any other liability or remedy that cannot lawfully be excluded. Consumer protections, data-protection compensation and responsibility for our own unlawful conduct remain subject to mandatory law. No clause makes a user waive statutory rights merely by using the service.
18. Responsibility for unlawful submissions
Business users submitting employer or affiliate content must reimburse reasonable, proven losses and third-party claim costs caused by their fraud, unlawful submissions or infringement of rights, to the extent permitted by law. This does not cover losses caused by our own breach or unlawful conduct.
We must give reasonable notice of a claim, allow a reasonable opportunity to respond or participate in its defence, and take reasonable steps to limit loss. No settlement imposing obligations on you may be agreed on your behalf without your consent. Ordinary consumers do not give an unrestricted indemnity for using the service.
19. No professional advice
We provide opportunity-discovery information. It is not legal, financial, tax, immigration, employment or other professional advice. Obtain independent advice where appropriate.
20. Privacy
Personal-data processing is governed by our Privacy Policy, which should be read together with these Terms.
21. Suspension, termination and review
We may restrict access for material breach, non-payment, suspected fraud or a real legal or security risk. Action must be proportionate. Where reasonably possible we will give reasons and a chance to remedy the issue; urgent protective action may precede notice. Contact support@lainetiv.com to request review.
Termination does not extinguish accrued consumer remedies or privacy rights, authorise indefinite retention, or automatically cancel payment-provider renewal. Payment and privacy requests must be handled separately as appropriate.
22. Changes to these Terms
Material changes require reasonable notice and any renewed acceptance required by law. Revised terms do not retrospectively remove accrued rights or authorise undisclosed charges. The effective version and applicable purchase disclosures govern the relevant agreement. This version takes effect on the date stated above, subject to any notice or acceptance required for existing agreements.
23. Kenyan law and mandatory international protections
Kenyan law governs these Terms, subject to mandatory consumer, privacy and other protections applicable to you. Where another country’s mandatory law applies, it is not waived by this choice of law.
Kenyan courts have jurisdiction subject to any mandatory right to use another competent court, regulator or statutory dispute process. You may contact support@lainetiv.com to seek resolution, but this does not require you to give up access to a court or regulator or let a legal deadline expire.
24. Severability
If any provision is found unlawful, invalid or unenforceable, it shall be limited or severed only to the extent necessary, and the remaining provisions shall continue in effect.
25. Entire agreement
These Terms and any specific purchase or service terms form the applicable service agreement. The Privacy Policy explains how personal data is handled; acknowledging it does not waive privacy rights or provide consent to unrelated processing. A specific written agreement with a company may govern where it expressly conflicts with these Terms.
